You must obtain and gain entry into an Investigational Review Board service (IRB).
Your Training company must furnish an IRB. It's the law!
You must be FDA compliant to provide stop smoking and weight loss trials in your state using low level laser. Beware if a laser distributor tells you that an IRB is not required. This is absolutely, positively, and unequivocally not true! No lasers have been approved by the FDA to treat smoking and weight control; therefore, an IRB is law. Beware if a distributor tells you that just anyone can open a clinic. The FDA and the IRB requires that you have a medically licensed person of some degree involved with your center, this would be called your Principal Investigator by the IRB, and that person would sign off on every chart. This medical person can work for you as the Principal Investigator, be an investor, overseer, or even an independent contractor. There are many ways you can structure this. Who is determined to be a medical person? You can enlist the services of an athletic trainer, LPN, NP, RN, MA, PT, OT, DC, pharmacist, psychologist or MD.
The above must be licensed in the state you are opening in.

Many distributors are overly anxious to get involved in this booming business opportunity. Their enthusiasm has brought caution to this new industry. Please Beware!
There is an enormous difference between a light emission device (LED) and a true laser. BEWARE!
The FDA has coded LED's and Lasers so that the consumer will have protection
when considering a purchase. Consumers must know the difference!
Q. Please explain the difference between a LED and a Laser and how are they are coded for my awareness?
A. The FDA has classified LED's as an ILY device and true lasers as a NHN device.
Q. What is ILY?
A. It is a device the uses thermal energy to provide pain relief through local heating. An ILY is dangerous because it can burn you.
Examples: ILY device information provided by the FDA: heating pads, hot packs, sunlamps and light emitting devices (LED's). BEWARE be extremely careful on what equipment you invest in as you may be forced to invest twice, you could be closed down or you could be fined. Make sure that the so called laser you purchase is not just a heat emitting device (LED).
Q. How can I tell if I am buying a true laser?
A. NHN is the code given to a true laser. This code will assure you that the NHN device is not stimulating with mere heat. NHN will be non-thermal, non-invasive while delivering billions of protons. Some of the companies that distribute a true laser are Theralase, Microlight, and Erchonia.
Q. What are some of the things that I should watch for in making a purchase?
A. Beware and be sure that you are buying NHN and NOT an ILY. (You can Google the laser or company name adding FDA 510K to verify. If you can not, please contact:

OTHER CAUTIONS:
A. Beware of Laser companies that ask you to assemble; that will release them of legal obligations and it places the liability directly on you.
A. Beware of words like components. Watch statements like treatment times 1-2 minutes.
A. Make sure your laser has a pre-set timer for all treatments. You do not have to verbally count down your treatment time. This is dangerous!
A. DO NOT invest in a laser and/or a LED if it has not cleared a 510K with the FDA. You want your investment to be legal!
A. Beware if your device looks like a flashlight and will run on regular flashlight batteries.
A. Beware if some companies tell you there laser is close to FDA approval for smoking and weight loss. Dealing with the FDA is a long hard road and everyone is working toward the same goal and at the same pace. Some people try to use this as a sales tool. Let that little "light" go off when you hear this. Maybe you can request the last correspondence from the FDA proving this statement. YOU will not get it!
A. Insist that you have contact names and phone numbers on the manufacturing company, not just the distributor. If the distributor says they are both, Beware!
You need a contact number at the manufacturing plant; you will have mfg. questions that can not wait to go through a chain of command.
A. Avoid overseas lasers, as some companies will charge you rent for a loaner laser until your laser is returned from overseas (2 to 3 months). Get this in writing if a distributor says they will not charge you for the loaner laser within the first two years.

A. Make sure the LASER you are investing in has a 510K clearance filed with the FDA. IF NOT, you are urged to stay away and beware!

A. Beware and read closely-is the laser FDA approved or is the facility they are being assembled in FDA approved? This is a HUGE difference. Beware! If your laser sounds too inexpensive to be true, (it is) you should make sure it has a FDA 510K. Maybe they can meet omitted criteria for approval? That could include SAFETY. Do you want to risk that?
A. Understand that no lasers are approved to do these treatments, which is why you must have an IRB. However your laser must have an FDA clearance for safety reasons.
NOTE: If a laser or LED has FDA clearance or approval that will mean they have been assigned a code of a LED or Laser... Check it out! Don't get caught with a no-name or an illegal and unregistered laser in your possession as you will regret it.
A. Safety first! Make sure your device has an automatic cut off at the end of the treatment. Your laser setting should be pre-set for perfect timing. Remember a LED device, a.k.a. ILY, can burn your client.
A. Insist you have preset treatments and many different protocols pre-set for pain, stress, addiction, smoking, weigh loss, etc., etc. PLUS, the most important thing is to make sure your laser does not become obsolete and it has the ability to hold future protocols in a pre-set mode. ASK this question; the more the BETTER!!
A. Insist on a true laser and one that is super-pulsed as this will be the true treatment that will provide you the greatest success in dealing with your weight patients.
A. Insist that your laser has built in self-testers and self-calibrators as this will assure you the laser is working perfectly for EVERY treatment that you are doing. Without this feature, how can you be aware of the effectiveness, safety, and precision? This is a must!
A. Demand that your laser has a self-finding acupressure point finder to maximize your ability to treat accurately. This is perfect for newer technicians.
A. If the LASER Company and the TRAINING Company can offer you 100% financing this would be a clue to an excellent group. Banks and/or leasing companies will never finance until they have intensively investigated the equipment, the warranty, the training, and on, and on. This is true credibility!
A. Finally you must demand a two year parts and labor warranty from the manufacturer. If this can not be furnished, this should "red flag" your purchase and should bring concern to your investment.
NOTE:

Q. I want to operate a legal center, will I be granted an IRB when I train?
A. That is a very simple question; if that training facility does not offer you an IRB you will NOT be legal and you run the risk of being closed, fined, and other unfavorable actions from the FDA. Why take that risk when it can be prevented?
Q. I want to open a clinic but don't know where to train, can you give me some help?
A. You did not say where you planned to open. If you plan to open in the USA, you should without a doubt train in the USA. This will assure you of compliance with the FDA. Don't travel outside the US where other laws are enforced. Also keep in mind that FDA laws are ever changing and it is your USA sponsors job to will keep you abreast and current with FDA rulings. Plus, why deal with passports, birth certificates, customs and misery when your own country has all the facilities you require? Some out of the country trainers have committed gross errors as they do not understand the IRB. Why risk it?
Q. What treatments are taught in a normal class and are those of extra cost?
A. NO extra cost is involved when training; you should be trained on many different aspects i.e. smoking, weight loss, stress, anxiety, depression, insomnia, addictions, pain, and many others. A course should teach you all of those things to make you a success in your business venture.
Q. I contacted a training company that featured several Lasers I could choose from, is this good?
A. Yes, always buy the laser from the place that trains you but I have a BIGGER concern with this question. That training company should only be selling the absolute best laser for the job. This is going to be your investment and your business, why have different choices? You should only be offered the absolute best laser for the treatment you will be training for.
Q. Why do some training facilities charge thousands and thousands of dollars and then send you to a laser distributor to buy a laser? This starts my questions all over again? I want to deal with one person!
A. To be honest I have only heard of this on a few occasions and both times it was companies that were outside of the USA.
Q. I asked a distributor if his laser was FDA cleared and his answer was that no laser has been approved for stop smoking and weight loss. It that true?
A. Do you see how he avoided your question by not answering that his laser had a 510K approval? He was correct that no laser has been approved, that is the purpose of the IRB. Ask if a 510K has been issued on the laser and then look it up!
Q. How many companies will offer 100% financing to the medical professionals?
A. We only know of one and that would us. The bankers and the leasing companies are very strict with this financing and you are investigated thoroughly to be able to provide this service. It does show extreme credibility. Thanks for the question.
Q. I am a busy professional and I want to be trained in my office with my staff. Is this advisable?
A. Yes, this is another service that we provide and we would be willing to discuss with you. In fact, we have several trainers that travel the USA. We even have those parties that will travel outside the USA.
Q. I notice that a few people will travel and hold training in hotels with groups of 8 to 15 people for 8 hours. This looks to be a cheaper way to be trained. What do you think?
A. I see people doing this to others that want to sincerely seek a business opportunity and all they do is LOOSE THEIR MONEY. I think this is a poor excuse for training and an exemption for any claims of being professional. Never group train with others in some hotel room for a few hours and then try to open a real business. You are setting you up for failure. There are too many faucets in a business plan for this to work. How can a person wanting to create business opportunities think this is acceptable? If you are not getting that personal attention for least 18 hours of in-depth training, if you are not taking a student from the grand opening, to daily reports, the annual reports, and all the IRB information then why waste your time and money? We pride ourselves in our 400 page training guide. How can you expect to open a successful business with limited and shared training over 8 hours? We have re-trained so many of these students that have "tried to save money."
Basically, do not sell yourself short!

Demand:
Make absolutely sure that the person training you has the exclusive right from that manufacturer to do so. Demand a contact name and phone number to verify this. Beware if the trainer states that they too are the manufacturer, this is highly doubtable. Protect against fraud; verify factory.
Stay clear of overseas manufacturers that you can not make direct contact with. The repairs take too long and it is way too costly, the cost of shipping is outlandish. Plus, how will you find out if "Mr. and Mrs. Smith" are truly authorized to authorize? GET a contact name and/or a number!
Before you sign up for a training course make 100% sure that you have an approved Principal Investigator.
Beware of a training facility that tries to sell you an off-brand IFY or LED machine and a training course at a reduced rate. Beware you will not have the ability to open and you WILL lose your money.
To truly experience this business opportunity you should insist on training in a functional office that is completely client ready in order to have a full and complete understanding of what your business profile should look like.
Never and I mean NEVER train with anyone that does not operate a free standing active clinic, how will you know what to do if they are not doing it? Insist on being in a working clinic and not hotel room!
